Canada Consumer Product Safety Act Now In Force
The Canada Consumer Product Safety Act (CCPSA) came into force on June 20, 2011. CCPSA will have significant implications for all companies involved in the consumer products supply chain. The Act will be administered by Health Canada and establishes a comprehensive regulatory regime for consumer products.
Key Elements of the Legislation:
- Government ordered recalls
- Mandatory incident reporting and document retention
- Progressive disciplinary action for non-compliance including fines of up to $5,000,000 (limited circumstances) and/or imprisonment of up to 2 years
- General prohibition on consumer products that pose an unreasonable danger to consumers
- Prohibitions related to packing labeling or advertising that is false, misleading or deceptive with respect to safety
- Government disclosure of confidential business information without consent (in certain circumstances)
